Terms of Service

These Terms of Service ("Terms") govern your use of akibo.space (the "Site"), the services provided by Akibo ("Akibo", "we", "us" or "our"), and our SMS program. Akibo is operated by AKIBO NATURAL PRODUCTS LLC (EDRPOU code 34529571), 5A Lesi Ukrainky Blvd, Kyiv 01133, Ukraine. By using the Site, submitting our contact form or using our services, you agree to these Terms. If you do not agree, do not use the Site or services.

1. Our services

Akibo provides paid social advertising services for food and beverage brands, including strategy and audience research, creative production, campaign setup and management, and reporting on platforms such as Facebook, Instagram and TikTok. The specific scope, deliverables, fees and term of any engagement are set out in a written proposal or agreement with the client. If that agreement conflicts with these Terms, the agreement controls.

2. No guarantee of results

Advertising results depend on many factors outside our control, including product, pricing, competition, platform algorithms and platform decisions. We do not guarantee any particular level of sales, leads, reach, return on ad spend or other results.

3. Fees and ad spend

Plans start from $800 per month. Fees for each client are stated in the client's proposal or agreement. Advertising spend is not included in our fees and is paid by the client directly to the advertising platforms.

4. Client responsibilities

• Provide accurate information and timely access to the ad accounts, analytics and materials we need.
• Make sure you have the rights to the logos, images, videos, music and other materials you give us.
• Make sure product claims, including nutrition, health and ingredient claims, are truthful and comply with applicable laws and regulations.
• Comply with the terms and advertising policies of each platform where your ads run.

5. Intellectual property

The Site and its content, including text, design and graphics, belong to Akibo or its licensors. Materials you provide remain yours. Ownership and usage rights for creative we produce for you are set out in your agreement with us.

6. Use of the Site

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting false information or automated requests, or using it for any unlawful purpose.

7. SMS Program

Program description. Akibo sends text messages with updates about our services and consultations, such as replies to your inquiry, audit and call scheduling, and information about our services. You join the program by checking the text messaging consent box on our contact form and submitting the form with your phone number.

• Message frequency varies.
• Msg & data rates may apply. Check your mobile plan for details.
• Opt out: reply STOP to unsubscribe at any time. We also accept UNSUBSCRIBE, CANCEL, END, QUIT and STOPALL. You will receive one message confirming that you have been unsubscribed, and no further messages after that. To join again, reply START or submit the contact form again with the consent box checked.
• Help: reply HELP for help, or contact us at [email protected].
• Consent is not a condition of purchase.
• Carriers are not liable for delayed or undelivered messages.

For information about how we handle your mobile number and messaging data, see our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

8. Third-party platforms

Facebook, Instagram and TikTok are operated by third parties that are not affiliated with Akibo. Their terms and policies apply to ads run on their platforms. We are not responsible for platform decisions, including ad rejections, account restrictions, policy changes or outages.

9. Disclaimers

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Akibo will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Site or our services will not exceed the fees you paid us for the services in the three months before the event giving rise to the claim.

11. Termination

We may suspend or end access to the Site at any time. Termination of client engagements is governed by the client's agreement with us.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continued use of the Site after changes take effect means you accept the updated Terms.
